Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Yokoi, LLC. ("Company," "we," "us," or "our") governing your access to and use of the Hearing Highlights service, including our website, applications, and any related services (collectively, the "Service").

Please read these Terms carefully before using the Service. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

Description of Service

Hearing Highlights is a congressional hearing intelligence service that provides users with transcripts, summaries, and analysis of congressional hearings. The Service includes access to congressional hearing transcripts with speaker identification, personalized email digests of relevant hearings, AI-generated summaries and relevance notes, real-time alerts for paid subscribers, and additional features as described on our website.

Eligibility

The Service is intended for business and professional use only. By using the Service, you represent and warrant that you are at least 18 years of age, you have the legal capacity to enter into a binding agreement, you are using the Service for business or professional purposes, you have the authority to bind any organization on whose behalf you are using the Service, and your use of the Service does not violate any applicable law or regulation. We require a valid work email address to create an account. Personal email addresses (e.g., Gmail, Yahoo, Outlook) may be rejected.

Account Registration and Security

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to create a strong, unique password, not share your account credentials with any third party, notify us immediately of any unauthorized access to or use of your account, and log out of your account at the end of each session when using a shared device. We reserve the right to disable any account at any time if we believe you have violated these Terms.

Subscription Plans and Fees

Free Tier. We offer a free tier that includes a morning digest of previous day's hearings, one-sentence relevance notes, access to full hearing transcripts, and sponsored content included in emails. The free tier may be modified or discontinued at any time at our sole discretion.

Paid Subscriptions. We offer paid subscription plans with additional features as described on our pricing page, including personalized five-bullet summaries, real-time alerts (approximately 15 minutes after hearing ends), organization mention alerts, and an ad-free experience.

Fees and Payment. Fees for paid subscriptions are as stated on our pricing page at the time of purchase. You agree to pay all fees associated with your subscription plan, provide valid and updated payment information, and authorize us to charge your payment method for recurring subscription fees. All fees are quoted in U.S. dollars unless otherwise specified and are exclusive of taxes, which you are responsible for paying.

Billing Cycle. Subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select. Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date.

Price Changes. We reserve the right to change subscription fees at any time. If we change fees for your subscription plan, we will provide at least 30 days' notice before the change takes effect.

Refund Policy

30-Day Guarantee for New Subscribers. New paid subscribers may request a full refund within 30 days of their initial subscription purchase. This guarantee applies only to your first subscription purchase and is limited to one refund per customer.

After the Guarantee Period. After the 30-day guarantee period, all subscription fees are non-refundable. You may cancel your subscription at any time, but you will not receive a refund for any unused portion of your current billing period.

To request a refund under the 30-day guarantee, contact us at privacy@hearinghighlights.com within 30 days of your initial purchase. Refunds will be processed within 10 business days.

Cancellation

Monthly Subscriptions. Monthly subscriptions may be canceled at any time. Upon cancellation, you will retain access to the Service until the end of your current billing period. No refund will be provided for the remaining portion of the billing period.

Annual Subscriptions. Annual subscriptions require a commitment for the full annual term. If you cancel an annual subscription before the end of the annual term, you will retain access to the Service for the remainder of the annual term, but no refund will be provided. Annual subscriptions may be set to not renew at any time before the renewal date.

Effect of Cancellation. Upon cancellation or expiration of your subscription, your access to paid features will terminate at the end of your billing period, you may be downgraded to the free tier, and certain data associated with your account may be deleted in accordance with our Privacy Policy.

Intellectual Property

Company Intellectual Property. The Service, including its original content (excluding congressional hearing transcripts and other public domain content), features, functionality, and underlying technology, is owned by Yokoi, LLC. and is protected by intellectual property laws. This includes our website design and user interface, our proprietary algorithms and AI models, our trademarks, logos, and branding, and original analysis, summaries, and other content we create. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

Congressional Content. Congressional hearing transcripts and related government documents are works of the United States federal government and are in the public domain. Our value-added services (AI-generated summaries, speaker identification, relevance analysis, and personalization) are proprietary to Yokoi, LLC.

User Feedback. If you provide us with any feedback, suggestions, ideas, or other input regarding the Service, you hereby grant us a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable license to use, modify, reproduce, distribute, and otherwise exploit such feedback for any purpose without compensation or attribution to you.

AI-Generated Content Disclaimer

Important: The Service uses artificial intelligence to generate summaries, relevance notes, and other analysis of congressional hearings. You acknowledge and agree that:

• AI-generated content may contain errors. Despite our best efforts, AI-generated summaries, relevance notes, speaker identifications, and other analysis may be inaccurate, incomplete, or misleading.
• Not a substitute for professional advice. AI-generated content is provided for informational purposes only and does not constitute legal, policy, regulatory, or professional advice. You should not rely solely on AI-generated content for making business, legal, or policy decisions.
• Verify independently. You are responsible for independently verifying any information obtained through the Service, particularly before taking action based on such information.
• Transcription accuracy. While we use advanced technology for transcription and speaker identification, errors may occur. Official congressional transcripts, when available, should be consulted for authoritative records.

We disclaim all liability for any errors, omissions, or inaccuracies in AI-generated content and for any actions taken or not taken based on such content.

Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Engage in any fraudulent, deceptive, or misleading activity
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Attempt to gain unauthorized access to any part of the Service or any other systems or networks
• Use any automated means (bots, scrapers, etc.) to access the Service without our express consent
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove any copyright, trademark, or other proprietary notices from the Service
• Resell, redistribute, or sublicense access to the Service without our authorization
• Use the Service in any manner that could damage, disable, or impair the Service
• Harass, abuse, or harm another person or entity

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limiting the foregoing, we do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, that the Service or servers are free of viruses or other harmful components, that the results obtained from using the Service will be accurate, reliable, or meet your requirements, or that the Service will be available at any particular time or location. We do not guarantee any specific uptime or availability.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Yokoi, LLC., its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service, any conduct or content of any third party on the Service, any content obtained from the Service, unauthorized access, use, or alteration of your transmissions or content, errors, inaccuracies, or omissions in AI-generated content, or decisions or actions taken based on information provided by the Service.

In no event shall our total liability to you for all claims arising out of or relating to these Terms or your use of the Service exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Yokoi, LLC. and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, your violation of any third-party rights, including intellectual property rights, any content you submit to the Service, or your violation of any applicable law or regulation.

Termination

Termination by You. You may terminate your account at any time by contacting us or using the account cancellation feature in your account settings.

Termination by Us. We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms, fraudulent, abusive, or illegal activity, non-payment of fees, extended periods of inactivity, requests by law enforcement or government agencies, or discontinuation of the Service.

Effect of Termination. Upon termination, your right to use the Service will immediately cease, you remain liable for all fees incurred prior to termination, and provisions that by their nature should survive termination will survive, including intellectual property provisions, warranty disclaimers, indemnification, and limitations of liability.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be instituted exclusively in the federal courts of the United States or the courts of the State of Delaware, and you consent to the personal jurisdiction of such courts.

Dispute Resolution

Informal Resolution. Before filing any legal claim, you agree to attempt to resolve any dispute informally by contacting us at privacy@hearinghighlights.com. We will attempt to resolve the dispute informally within 60 days.

Class Action Waiver. You and Yokoi, LLC. agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

General Provisions

Entire Agreement. These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Yokoi, LLC. regarding the Service and supersede all prior agreements and understandings.

Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment. You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Force Majeure. We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

Notices. We may provide notices to you via email to the address associated with your account or by posting on the Service. You may provide notices to us by email to privacy@hearinghighlights.com.
